Welcome to ListaLive! These Terms and Conditions (“Terms”) govern your access to and use of our website, services, and platform (collectively, the “Service”). By using ListaLive, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

– You must meet the minimum age requirements to use ListaLive:
– United States: 13 years or older
– European Union / United Kingdom: 16 years or older
– Elsewhere, including Canada: 13 years or older
– Users may not submit or post images, videos, or other media depicting individuals under the applicable minimum age without verifiable parental or guardian consent.
– By using the Service, you represent that you meet the applicable age requirement and are capable of forming a binding contract.

2. Accounts

– To access certain features, you must create an account. You agree to provide accurate information and maintain the security of your account.
– You are responsible for all activity under your account.
– ListaLive reserves the right to suspend or terminate accounts that violate these Terms.

Acting on behalf of a business: 

– If you access ListaLive on behalf of a business, that business agrees to these Terms and is responsible for all activity conducted under your account.

3. User Content

– Users may submit listings, images, videos, or other content (“User Content”).
– You retain ownership of your content but grant ListaLive a non-exclusive, worldwide, royalty-free, perpetual license to display, distribute, and promote it as part of the Service.
– You are responsible for your User Content and must not post content that is illegal, offensive, or infringes on others’ rights.
– Users must have all necessary rights and consents for any content they submit, including consent from individuals appearing in media.

4. Prohibited Conduct

You agree not to:
– Violate any laws or regulations
– Post fraudulent, misleading, or infringing content, as well as posting content of individuals under the minimum age without consent 
– Attempt to hack, disrupt, or reverse-engineer the Service 
– Harass, threaten, or harm other users 
– Use automated tools (bots, scrapers, spiders) to collect content or access the Service without permission

Moderation & Investigation: 

– ListaLive may block, remove, or limit access to content or accounts at its discretion.
– We may investigate accounts or content suspected of violating these Terms, applicable law, or our policies.
– We reserve the right to cooperate with law enforcement authorities regarding any illegal activity or harmful content. 
– You agree not to circumvent such moderation or investigation.

5. Disclaimer of Warranties

– ListaLive provides the Service “as is” and “as available.”
– We do not guarantee accuracy, completeness, or uninterrupted access.
– Your use of the Service is at your own risk.

6. Limitation of Liability

– ListaLive is not liable for indirect, incidental, or consequential damages arising from your use of the Service.
– Our total liability will not exceed the amount you paid to ListaLive in the 12 months preceding any claim.

7. Indemnification

– You agree to indemnify and hold harmless ListaLive, its officers, employees, and partners from any claims, damages, or losses arising from your use of the Service or violation of these Terms.

8. Termination

– We may suspend or terminate your account for violations of these Terms or for any reason at our discretion.
